Once again, the General Directorate of Taxation extended the term for the presentation of the declaration of inactive companies. Before going into detail to mention the new term, it is important to remember that inactive companies are those that do not have a lucrative activity registered in the Treasury but who own properties. In Costa Rica it is very common for people to have their car or house in a partnership, if that is your case, take note of this information, which may interest you.
In order to comply with this obligation, the simplified form D-101 must be completed in the Virtual Tax Administration (ATV), in which the information regarding liabilities, assets, and capital stock must be filled out. Avoid fines! Failure to submit this declaration can lead to fines of up to three base salaries, that is, approximately ¢1,387,000.
Originally this term ended on March 15th, 2022, but was extended to June 15th of this year. Due to the hacks suffered on the website of the Ministry of Finance, this last term was extended until August 16th and on Friday, August 5th, the General Directorate of Taxation announces that due to concerns expressed by taxpayers, this obligation is extended until November 15th, 2022. The above due to the resolution DGT-R-21-2022 that will be published in the Official Gazette in the coming days. We will be very attentive to this resolution since the announcement indicates that the administration will make some clarifications to the regulations.
The presentation of this declaration is an annual obligation that inactive companies in the country must comply with. As well as the payment of the tax on legal companies, which must be made no later than January 31st of each year to avoid paying fines, and the declaration of the Registry of Transparency and Final Beneficiaries that must be made annually during April of each year or once it is modified.
